Version 2026-11-01

SlopeSense — End User License Agreement & Terms of Service

Effective 2026-11-01 · Operated by Robert Swanson (“we”, “us”, “SlopeSense”) · See also our Privacy Policy and US State Privacy Notice.

1. Acceptance

By creating an account, uploading a video, or otherwise using SlopeSense (the “Service”), you agree to this EULA & Terms of Service (the “Terms”), the Privacy Policy, and the US State Privacy Notice, each incorporated by reference. If you do not agree, do not use the Service. We record your acceptance (date, time, and terms version).

2. Definitions

  • “Your Content” — videos, images, telemetry (including imported Carv data), and other materials you upload or provide.
  • “Derived Data” — data the Service computes from Your Content, including pose keypoints, joint angles, ski-to-slope edge angles, and metrics.
  • “Subject” — any identifiable person appearing in Your Content.

3. License to use the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal coaching use, subject to these Terms. All rights not expressly granted are reserved. You may not resell, sublicense, or provide the Service to third parties except as expressly allowed.

4. Eligibility and minors

  • You must be at least 18 years old to create an account; by registering you represent that you are.
  • Minors do not hold accounts. Only adults 18 or older may create or hold an account. The Service has no athlete accounts for minors. Minors (e.g., junior racers) may appear only as Subjects in video uploaded and managed by a consenting adult account holder.
  • Minors as Subjects: If any Subject is under 18, you represent that you are that minor’s parent or legal guardian, or that you have obtained verifiable consent from the minor’s parent or legal guardian, before uploading (see Sections 8–9).
  • We do not knowingly collect personal information from children under 13. If we learn we have, we will delete it (contact Section 19).

5. Accounts and security

You are responsible for your credentials and all activity under your account. Notify us promptly of any unauthorized use.

6. Subscriptions, billing, and automatic renewal

PLEASE READ — AUTOMATIC RENEWAL. Paid subscriptions automatically renew and your payment method will be charged each period until you cancel.

  • Plans and processor. Paid plans are billed on a recurring basis (monthly or annual, as shown at checkout) through our payment processor, Stripe. We do not store your full card number.
  • Automatic renewal. Your subscription renews automatically at the end of each billing period at the then-current price, and we will charge your payment method for each renewal, until you cancel. By subscribing, you affirmatively consent to these recurring charges.
  • How to cancel. You may cancel at any time from your account billing page (the Stripe customer portal). Cancellation stops all future renewals.
  • Refunds. When you cancel, we refund the unused whole months remaining in your current billing term, and your subscription ends at that time. For monthly plans, we refund the charge for your current billing month. For annual plans, we refund each whole month remaining in the annual term (the current, partially-used month is not refunded). We do not refund partial months or months already used.
  • Price changes. We give advance notice before any price change applies to your next renewal; continued subscription after the effective date is consent to the new price.
  • Taxes. Prices exclude applicable taxes unless stated.

7. Your data belongs to you

  • You own Your Content and Derived Data. Nothing in these Terms transfers ownership of it to us.
  • Purge on request. At any time you may ask us to purge Your Content and Derived Data from the Service — from Profile → Privacy settings, or by contacting us (Section 19). We complete the purge within 30 days, except where the law requires us to keep a record (for example, billing records).
  • License to operate. You grant us a worldwide, non-exclusive, royalty-free license, which ends when Your Content is purged, to host, store, reproduce, transcode, analyze, create Derived Data from, and display Your Content solely to provide the Service to you and the people you share it with.
  • Training is optional. Using Your Content to improve our models is a separate, optional permission described in Section 10. It is on by default and you can switch it off at any time.

8. Consent to technique (body-position / biometric) analysis

To generate feedback, the Service computes a stick-figure skeleton of joint positions, joint angles, and ski-to-slope edge angles from video of identifiable people. This may constitute biometric or body-position data under some laws (see the US State Privacy Notice for details and our retention schedule).

By uploading a video and accepting these Terms, you consent to this processing, and you represent that you have this same consent from every Subject in the video (and, for any minor Subject, from that minor’s parent or legal guardian). We do not sell your biometric or body-position data.

9. Your representations regarding Subjects

You represent and warrant that: you own or have the rights to Your Content; you have obtained the consent required by Section 8 from every Subject (and from the guardians of minors); Your Content does not infringe or violate anyone’s rights; and you will not upload content you lack these rights to.

10. Optional model training

With your permission, we use Your Content and Derived Data (including coach corrections) to train, validate, evaluate, and improve our models. This permission is on by default and is optional: you can turn it off at any time in Profile → Privacy settings, and turning it off does not limit your use of the Service. When it is off, or once you request a purge, we stop using Your Content for any new training. We cannot reverse training already performed before that point. Training data is never sold, and model outputs we publish are aggregated or de-identified so they do not identify you.

11. Third-party processors

We use third parties to run the Service, including cloud hosting and storage (Google Cloud Platform), AI/vision providers (e.g., Anthropic for assessment drafting), and payments (Stripe). See the Privacy Policy for the current list and locations, including cross-border processing.

12. Acceptable use

You agree not to: upload content you lack rights to or Subject consent for; upload unlawful, infringing, or harmful content; attempt to re-identify de-identified data; reverse engineer, scrape, or overload the Service; or use the Service to build a competing dataset or model.

13. AI feedback is not professional advice; assumption of risk

Feedback is educational technique feedback only — it is not professional, coaching-certification, medical, physical-therapy, safety, or emergency advice, and it creates no professional relationship.

Skiing is inherently dangerous. You assume all risks of skiing and of acting on any feedback. Ski within your ability, follow the mountain’s rules and “Your Responsibility Code,” and use appropriate equipment and supervision.

14. Our intellectual property

The Service — its software, models, overlays, and design (excluding Your Content) — is owned by us and protected by law. All rights not granted are reserved.

15. Copyright / DMCA

Send infringement notices to the contact in Section 19 with the information required by the DMCA (17 U.S.C. §512). We respond to valid notices, remove infringing content, and terminate repeat infringers.

16. Disclaimers; limitation of liability; indemnification

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that feedback is accurate or that the Service will be uninterrupted or error-free.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$50.

You agree to indemnify and hold us harmless from claims arising out of Your Content, your breach of these Terms, or your failure to obtain any consent required by Sections 8–9 (including from Subjects and minors’ guardians).

17. Termination

You may stop using the Service, delete your account, and request a purge of your data (Section 7) at any time. We may suspend or terminate access for violation of these Terms or as needed to comply with law. Sections 13, 14, and 16 survive termination.

18. Changes; dispute resolution; governing law

We may update these Terms; material changes take effect on notice and, where required, on your acceptance of the new version. We keep prior versions and your acceptance record. These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-laws rules.
